Agreement, Waiver of Liability, and Media Release
I acknowledge that I am attending the specified event(s) “the Event” offered by and through Heart and Soul Wellness, LLC of my free will and volition. In consideration for my attendance at the Event I agree as follows:
As an Event attendee, I voluntarily choose to participate in Event activities, teachings and offerings, including Tao Calligraphy Field; meditations, movement, discussions, teachings, blessings or spiritual services (the “Event Activities”) offered by Heart and Soul Wellness, LLC, parties contracted by Heart and Soul Wellness, LLC and/or Dr. & Master Zhi Gang Sha, Universal Soul Service, other Certified Master Teachers, Tao Hands Practitioners or other Practitioners certified by the Tao Academy™ or the affiliates, directors, officers, staff, agents, assigns or successors of any businesses related to or affiliated with this Event (collectively, the “Event Parties”). Certified Master Teachers, and Tao Hands Practitioners may offer Special Services, which carry divine love, light, forgiveness, compassion and more. Although some of these persons may be licensed health care practitioners, I understand that in connection with this Event, and any related teachings, practices, or Special Services, they are not acting in their capacity as licensed health care practitioners.
The teachings, practices, blessings or services offer to transform negative information into positive information. These can be offered in person or remotely, over the telephone, without touching in an audience setting at an event, or through other services, all of which may be offered at the Event.
1. Personal Responsibility for Physical, Mental, and/or Medical Care and Release of Liability. I acknowledge the Event Activities may cause, result, or involve increased mental, emotional or physical symptoms in some people. I am solely responsible for and prepared to handle any such symptoms including but not limited to my own pre-existing physical, mental, emotional and/or medical conditions. I further acknowledge and agree that I have not been hospitalized for mental health reasons at any time during the last 5 years, and if so, have provided Heart and Soul Wellness, LLC with a signed waiver by my treating physician or mental health practitioner. Furthermore, if I should require or desire emergency or professional medical attention, I am responsible for all costs associated with my care regardless of the cause. I release the Event Parties, their contractors, associates, assigns, volunteers, and any and all persons associated with preparing and offering the Event and of any and all liability associated with any pre-existing or subsequent illness or injury, physical, mental, emotional, or otherwise, that may result or arise, directly or indirectly from or as a result of my participation in the Event, receiving Special Services, blessings, or other products, or services offered during or in association with the Event or attendance at the event location.
2. Teachings, Special Services, or Products Do Not Replace Licensed Medical or Psychological Care. I acknowledge and understand that the teachings, blessings, Event Activities, and/or Special Services do not and are not intended to replace, replicate, modify, or substitute for licensed medical or psychological care in any way, shape or form. The Event Parties are not offering any Special Services, products, blessings or any services as a replacement or substitute for conventional or licensed medical and/or psychological evaluation, diagnosis, advice, care, and/or treatment. For any and all existing or new health-related issues, I will seek the help of a licensed physician or other healthcare professional.
3. No Healing Changes or Results Promised. The Teachings, Special Services, and Products relate only to the spiritual or quantum messages and information. I understand that the Event Personnel make no representations or promises that I will receive or experience any change or improvement whatsoever in any area or condition of my life or my health from receiving any service or participating in the Event.
4. Intellectual Property Acknowledgment. I acknowledge that all physical and electronic materials related to the services, products, teachings and blessings offered by or through the Event Parties are proprietary, reserved and/or copyrighted or trademarked intellectual property of Dr. and Master Zhi Gang Sha and/or his respective organizations or of others. These materials include, but are not limited to, books, CDs, DVDs, digital audio and video media and content, text in publications other than books, text on websites, photographs, other images and other design elements (collectively the “Proprietary Materials”). I acknowledge and understand that the Proprietary Materials cannot be made, reproduced or disseminated for any commercial or other purposes outside of the work of Universal Soul Service Corporation, Tao Academy™, and/or other organizations and affiliates of Master Zhi Gang Sha without express written consent and authorization, whether such consent and authorization are freely given or are through a licensing agreement.
5. No Photography, No Audio Recording, No Video Recording. I understand and agree that the purpose of this event is to create a sacred space for the Event Activities. I also understand that the Tao Calligraphies are sacred. I understand and agree that I will not photograph, make any audio or any video recording of anyone or anything within the event space including but not limited to any of the Tao Calligraphies. I also understand that there will be an official Event Photographer. If I do not wish to be photographed by the Event Photographer or appear on webcast, I can sit in a section marked and reserved for no photography and no webcasting. The Event Parties will use reasonable efforts to avoid direct filming (i.e. showing face) but sometimes even persons in area reserved for no photography may be visible from the back such as in the background of a particular picture or video.
6. Media Release. I understand that my participation in any Event, retreat, workshop, teleclass activities and other events could involve my voice, statements, words, image or likeness may be photographed, filmed, videotaped, audio taped, transcribed, printed or quoted (collectively, the “Materials”). I hereby irrevocably grant to the Event Parties for any purpose, including advertising and promotional purposes, for all media and formats throughout the world (including print, internet, film, radio and television broadcast and/or other electronic medium present) the full, perpetual and exclusive right, to use, publish, distribute and/or incorporate (alone or together with other materials), in whole or in modified or edited part, the Materials, which may include my name and likeness, photographs, video footage or audio recordings taken of me, my voice, statements and/or words provided by me as a result of my participation in or attendance at an event with any of the Event Parties. This agreement shall not obligate the Event Parties to use the Materials or to use any of the rights granted hereunder, or to prepare, produce, exhibit, distribute or exploit the Materials. The Event Parties shall have the right to assign their rights hereunder, without your consent, in whole or in part, to any person, corporation or other entity.
7. VOLUNTARY WAIVER OF CLAIMS. IN CONSIDERATION OF BEING ALLOWED TO ATTEND AND PARTICIPATE IN THE EVENT, I HEREBY AGREE TO WAIVE AND RELEASE ANY AND ALL CLAIMS FOR DAMAGES, INJURY OR LOSS OR OTHER LIABILITY RELATED TO MY ATTENDANCE AND PARTICIPATION IN THE EVENT AGAINST THE EVENT PARTIES INCLUDING THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS AND VOLUNTEERS (THE “RELEASEES”), INCLUDING, BUT NOT LIMITED TO, ANY CLAIM ARISING IN CONTRACT OR IN TORT, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, THAT I, MY FAMILY, OR ANY PERSON REPRESENTING ANY INTEREST IN ME MAY HAVE NOW OR IN THE FUTURE; I AGREE THAT MY SOLE REMEDY IS TO LIMIT OR DISCONTINUE MY PARTICIPATION AND ATTENDANCE OF THE EVENT, ALL OF WHICH I UNDERSTAND IS MY VOLUNTARY CHOICE.
